ARTICLE 5 - DISCRIMINATION AND HARASSMENT
5.01 Discrimination
There shall be no discrimination by the Employer or its representatives or the
Union or employees, against any employee or employees in any manner whatsoever
because of race, colour, creed, sex, age, marital status, religion, nationality,
sexual orientation, place of residence, ancestry, place of origin, or lawful
union activities consistent with the provisions of this Agreement.
5.02 a) Sexual Harassment
Sexual harassment represents an unwarranted intrusion upon an employee's basic
rights, dignity and personal integrity.
b) Personal Harassment
Personal harassment is any personally-oriented practice inconsistent with the
proper functioning of the workplace that undermines an employee's health or
job performance, or endangers an employee's employment status or potential.
Every employee has the right to be free from sexual or personal harassment and
from any reprisal or threat of reprisal for the rejection of such behaviour.
The parties agree to jointly co-operate to ensure that allegations of harassment
are effectively dealt with and to ensure those who make such allegations in
good faith are able to do so without fear of reprisal.
5.03 Grievances
An employee shall have the right to file a grievance alleging that an incident
of sexual or personal harassment has occurred. Such grievances will be initiated
at Step 2 of the grievance procedure.
